Where the rules come from (checked 1 Nov 2026)
- What a payment schedule must contain: Construction Contracts Act 2002, s21(2)(a) to (c) and, if the scheduled amount is less than the claimed amount, s21(3)(a) to (c). Read word for word on legislation.govt.nz (version as at 5 October 2023, the latest).
- When it must be provided: s22(b), the time the contract requires or, if it doesn't say, 20 working days after the claim is served. Not provided in time: the payer becomes liable to pay the claimed amount on the due date (s22).
- Paying the scheduled amount: if it isn't paid in full by the due date, the payee may recover the unpaid part as a debt and serve notice of intention to suspend work (s24(1) and (2)).
